1. INTRODUCTION

Welcome to FindYourLocum ("Platform", "we", "our", or "us"). These Terms of Use ("Terms") govern your access to and use of our mobile application and website services that connect healthcare professionals with healthcare facilities seeking temporary or locum staffing solutions.

By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Platform.

These Terms should be read in conjunction with our Privacy Policy, Refund Policy, and Service Delivery Policy.

2. DEFINITIONS

  • "Healthcare Professional" or "Locum" means any registered medical practitioner, nurse, pharmacist, or other healthcare provider using the Platform to find locum opportunities.
  • "Healthcare Facility" or "Practice" means any hospital, clinic, pharmacy, medical practice, or healthcare institution using the Platform to find locum staff.
  • "User" means any Healthcare Professional or Healthcare Facility registered on the Platform.
  • "Shift" means a temporary work engagement posted by a Healthcare Facility.
  • "HPCSA" means the Health Professions Council of South Africa.
  • "KYC" means Know Your Customer verification procedures.

3. ELIGIBILITY

To use the Platform, you must:

  • Be at least 18 years of age
  • Have legal capacity to enter into binding contracts
  • For Healthcare Professionals: Hold valid registration with the HPCSA or relevant statutory council
  • For Healthcare Facilities: Be a legally registered healthcare institution in South Africa
  • Provide accurate and complete registration information
  • Successfully complete our verification process

4. KYC (KNOW YOUR CUSTOMER) REQUIREMENTS

Information collected from individuals during sign-up is limited to personal and professional details necessary to verify that he or she is a legitimate, registered healthcare professional with the HPCSA (or the relevant statutory council). This information enables us to confirm identity, validate professional credentials, and ensure that only qualified practitioners are matched with healthcare facilities.

4.1 Information We Collect

In addition to basic personal information, we typically collect:

Identification Details

  • Full name
  • ID/passport number
  • Date of birth
  • Contact information (email, phone number, address)

Professional Registration Details

  • HPCSA (or equivalent council) registration number
  • Category of registration
  • Proof of active registration
  • Any supporting documentation required for validation

Qualifications and Work History

  • Copies of certificates, degrees, or other documents confirming qualifications
  • Optional employment or locum history to strengthen profile accuracy

Compliance Documentation

  • Police clearance certificates (where required)
  • Indemnity insurance proof
  • Vaccination records (depending on facility requirements)

Account Information

  • Email address
  • Phone number
  • Login credentials used to facilitate secure access to the platform

Important: We collect only the minimum information required for identity verification, credential validation, and safe matching of practitioners to facilities. All information is stored securely, used solely for onboarding and verification purposes, and is never shared with third parties without the individual's consent or a legitimate legal basis.

5. ENHANCED DUE DILIGENCE

Our enhanced due diligence focuses on ensuring that every individual signing up to the platform is a legitimate, qualified, and compliant healthcare professional. In addition to standard KYC checks, we conduct the following enhanced verification steps:

1Professional Registration Validation

We independently verify each practitioner's HPCSA (or relevant council) registration status, category, and whether the registration is active, suspended, or subject to restrictions.

2Cross-Checking of Credentials

Uploaded qualifications, certificates, and supporting documents are manually reviewed for authenticity and consistency with the practitioner's registration details.

3Identity and Profile Matching

Identification documents are cross-checked against council records and profile information to confirm that the individual is who they claim to be.

4Compliance Screening

Where applicable, we request and verify additional documents such as indemnity insurance, police clearance, background checks, or vaccination records required by healthcare facilities.

5Fraud Prevention Checks

We review for mismatched, altered, or suspicious documentation, duplicate profiles, or unusual activity during sign-up. Any concerns trigger a second manual review before the account is activated.

6Continuous Monitoring

Practitioner profiles are periodically re-verified to ensure continued compliance with HPCSA registration requirements and facility standards.

Our Commitment: These enhanced due diligence measures ensure that only legitimate, qualified, and compliant healthcare practitioners gain access to the platform, upholding safety and trust between professionals and facilities.

6. USER ACCOUNTS

6.1 Account Creation

  • You must provide accurate, current, and complete information during registration
  • You are responsible for maintaining the confidentiality of your login credentials
  • You must notify us immediately of any unauthorized use of your account
  • One person or entity may only maintain one account

6.2 Account Verification

  • All accounts are subject to our verification procedures
  • We reserve the right to request additional documentation
  • Unverified accounts may have limited access to Platform features
  • False or misleading information may result in account termination

6.3 Account Termination

  • You may terminate your account at any time by contacting support
  • We may suspend or terminate accounts for violation of these Terms
  • Termination does not relieve you of outstanding payment obligations

7. PLATFORM SERVICES

7.1 Matching Services

The Platform provides a marketplace connecting Healthcare Professionals with Healthcare Facilities. We facilitate:

  • Posting and discovery of shift opportunities
  • Profile matching based on qualifications and requirements
  • Communication between parties
  • Booking and scheduling management
  • Payment processing

7.2 Platform Role

FindYourLocum acts as an intermediary platform:

  • We are not an employer of Healthcare Professionals
  • We do not provide medical services
  • The contractual relationship for services is between the Healthcare Professional and Healthcare Facility
  • We facilitate payment processing but do not set service rates

8. PAYMENT TERMS

8.1 Payment Flow

FindYourLocum acts as an intermediary for all payments between Healthcare Facilities and Healthcare Professionals:

  • Healthcare Facilities remit payment to FindYourLocum for completed shifts
  • FindYourLocum subsequently disburses the applicable funds to the Healthcare Professional
  • Platform fees are deducted prior to disbursement to the Healthcare Professional

8.2 Payment Timelines

The following payment timelines apply to all transactions processed through the Platform:

  • Healthcare Facility to FindYourLocum: Payment is due within fourteen (14) days of the shift being marked as completed
  • FindYourLocum to Healthcare Professional: Upon receipt of payment from the Healthcare Facility, FindYourLocum will disburse funds to the Healthcare Professional within seven (7) days
  • Total Payment Cycle: The maximum period from shift completion to Healthcare Professional receiving payment is twenty-one (21) days

8.3 Shift Completion Verification

Payment obligations are triggered upon verified completion of a shift. Shift completion is determined by:

  • The Healthcare Professional checking in and checking out of the shift via the Platform
  • The Healthcare Facility confirming completion of the shift
  • Both confirmations being recorded on the Platform

Note: Funds are released upon verified shift completion and are not subject to any arbitrary holding or cooldown period. The payment timelines outlined above represent the standard processing windows required for administrative and banking procedures.

8.4 Platform Fees

  • Applicable fees are disclosed at the time of transaction
  • Fees may include service fees, payment processing fees, and other applicable charges
  • We reserve the right to modify fees with reasonable notice

8.5 Payment Security

  • All payments are processed through Paystack, a PCI-DSS compliant payment processor
  • We do not store complete credit card information on our servers
  • All transactions are encrypted using industry-standard security protocols

9. USER RESPONSIBILITIES

9.1 Healthcare Professionals

  • Maintain valid professional registration with HPCSA or relevant council
  • Keep qualifications and certifications current
  • Provide accurate availability information
  • Fulfill accepted shift commitments
  • Maintain appropriate professional indemnity insurance
  • Adhere to professional standards and ethics
  • Notify us of any changes to registration status

9.2 Healthcare Facilities

  • Provide accurate shift requirements and descriptions
  • Ensure a safe working environment for locums
  • Make timely payments for completed shifts
  • Comply with all applicable labor laws and regulations
  • Provide necessary equipment and resources for shift completion

10. PROHIBITED CONDUCT

Users are prohibited from:

  • Providing false or misleading information
  • Impersonating another person or entity
  • Using the Platform for any unlawful purpose
  • Circumventing Platform payment systems
  • Harassing, threatening, or discriminating against other users
  • Attempting to access other users' accounts
  • Interfering with Platform operations or security
  • Violating any applicable laws or regulations
  • Engaging in fraudulent or deceptive practices

11. DISPUTE RESOLUTION

We take disputes seriously and have established a fair resolution process. For full details, please refer to our Refund Policy.

11.1 Dispute Process

  • Disputes must be raised within 7 days of the relevant transaction or incident
  • Both parties will be given the opportunity to present their case
  • FindYourLocum makes the final executive decision after listening to both parties
  • All decisions are communicated in writing to both parties

11.2 Consequences of Misconduct

Any party found to be deceiving the other party will be subject to disciplinary action:

  • First offense: Formal warning issued to the account
  • Serious offense or repeat offense: Permanent ban from using our platform

12. INTELLECTUAL PROPERTY

  • All Platform content, trademarks, and intellectual property belong to FindYourLocum
  • Users retain ownership of their personal content and data
  • Users grant us a license to use submitted content for Platform operations
  • Unauthorized use of Platform intellectual property is prohibited

13. LIMITATION OF LIABILITY

  • The Platform is provided "as is" without warranties of any kind
  • We are not liable for the actions of Healthcare Professionals or Facilities
  • We are not responsible for medical outcomes or professional conduct
  • Our liability is limited to the amount of fees paid to us
  • We are not liable for indirect, incidental, or consequential damages

14. INDEMNIFICATION

You agree to indemnify and hold FindYourLocum harmless from any claims, damages, losses, or expenses arising from your use of the Platform, your violation of these Terms, or your violation of any third-party rights.

15. MODIFICATIONS TO TERMS

  • We may modify these Terms at any time
  • Material changes will be communicated via email or Platform notification
  • Continued use of the Platform constitutes acceptance of modified Terms
  • If you do not agree to modified Terms, you must discontinue use

16. GOVERNING LAW

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms or use of the Platform shall be subject to the exclusive jurisdiction of the courts of South Africa.
